TERMS OF SERVICE ("ToS")
These Terms of Service ("ToS") govern the use of hosting services provided by Hosteroid ("Company") to the user ("User" or "Customer"). By using our hosting services, the User agrees to abide by these ToS.

1. Account Setup and Use
1.1 Account Registration: Users must provide accurate and complete information during the registration process. Users are responsible for maintaining the confidentiality of their account credentials and for any activities conducted through their accounts. The use of fake names or false information is strictly prohibited. The Company reserves the right to suspend or terminate services if it is determined that the information provided is inaccurate, incomplete, or misleading.
1.2 Prohibited Activities: Users agree not to engage in any illegal, abusive, or unauthorized activities, including but not limited to:
a) Uploading or distributing malicious software, viruses, or any other harmful content.
b) Unauthorized access or attempting to access another user's account.
c) Violating any applicable laws or regulations.
d) Engaging in any activity that negatively impacts the server's performance or stability.
e) Email Spamming: Sending unsolicited bulk emails (spam) or engaging in any form of email abuse, including but not limited to phishing, spoofing, or using third-party email addresses without proper authorization.
f) Torrents: Hosting, distributing, or facilitating the sharing of copyrighted material through torrents or any other peer-to-peer file sharing protocol, without proper authorization.
g) Adult Content: Hosting or distributing explicit adult content, including pornography or sexually explicit material.
h) Child Pornography: Engaging in or facilitating the transmission, distribution, or storage of child pornography, which is strictly against the law and prohibited.
1.3 Correct and Valid Information: Users are required to provide correct, valid, and up-to-date information during the registration process and throughout the duration of service usage. The Company reserves the right to suspend or terminate services at any time if it is found that the information provided is inaccurate, incomplete, or intentionally falsified.
1.4 Single Account Policy: Each user is allowed to create and maintain only one account with the Company. Users found to be in violation of this policy may have their additional accounts suspended or terminated without notice.
1.5 Guidelines for Asian Clients: For our valued Asian clients, we kindly request that you use Latin characters (A-Z, a-z) when entering your name, address, and contact details during the account setup. While we appreciate the beauty and diversity of different scripts, using Latin characters helps us maintain consistency and ensures that your information is accurately processed.
2. Service Provision and Uptime
2.1 Service Availability: The Company strives to provide continuous service availability, but the User acknowledges that interruptions may occur due to scheduled maintenance, hardware or software failures, or other unforeseen circumstances.
2.2 Uptime Guarantee: The Company will make reasonable efforts to maintain a high level of uptime for its services. However, the Company does not guarantee uninterrupted service and shall not be held liable for any damages or losses incurred due to service disruptions.
3. Payment and Billing
3.1 Payment Terms: Users are responsible for the payment of fees associated with the hosting services as agreed upon during the account registration or upgrade process.
3.2 Automatic Renewal: Unless otherwise specified, hosting services will automatically renew at the end of each billing cycle. Users must provide timely notice to the Company if they wish to cancel or modify their services.
3.3 Refunds: Refunds are subject to the Company's refund policy, as outlined on the website or as agreed upon during the account registration.
3.4 Refunds for Special Promotion Packages: Refunds for special promotion packages, such as those paid for one year with limited batch offers, will only be provided in the event of service disruptions or failures that prevent the proper functioning of the services. Refunds will not be granted if the client ordered such packages by mistake or for any other reason deemed fraudulent or manipulative. The Company reserves the right to investigate and verify the circumstances surrounding refund requests for special promotion packages.
3.5 Refusal to Pay for Remote Hands Service: Clients who refuse to pay for the remote hands service and insist on direct access to our racks or expect us to pick up their server without utilizing our services may have their requests denied. In such cases, clients are expected to adhere to the procedures outlined in this section for equipment pickup.
4. Data and Privacy
4.1 Data Security: The Company employs industry-standard security measures to protect user data. However, the User acknowledges that no system is entirely immune from security risks, and the Company shall not be liable for any unauthorized access, loss, or disclosure of user data.
4.2 Privacy Policy: The Company's privacy practices are outlined in the Privacy Policy, which is considered an integral part of these ToS.
5. Intellectual Property
5.1 Ownership: The User retains ownership of any intellectual property rights pertaining to the content they upload to the Company's servers.
5.2 License: By uploading content to the Company's servers, the User grants the Company a non-exclusive, worldwide license to use, reproduce, modify, adapt, and publish the content solely for the purpose of providing hosting services.
6. Limitation of Liability
6.1 Disclaimer of Warranties: The Company provides hosting services on an "as is" and "as available" basis, without any warranties or guarantees, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
6.2 Limitation of Liability: The Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of its hosting services.
7. Termination
7.1 Termination by User: Users may cancel their hosting services at any time by following the termination procedures specified on the Company's website.
7.2 Termination by Company: The Company reserves the right to suspend or terminate a user's account if the User violates these ToS or engages in any activity that may disrupt the Company's services or pose a risk to other users.
8. Colocation Services and Equipment Pickup
Equipment Pickup Procedure:
8.1 Access to Datacenter Racks: Access to our datacenter racks is restricted to authorized personnel only. Clients are not permitted to directly access the racks where other clients' equipment is housed. This policy is in place to maintain the security and integrity of our datacenter environment and to protect the equipment and data of all our clients.
8.2 Remote Hands Service: Clients who require assistance with equipment pickup and shipping can utilize our datacenter remote hands service. This service involves an additional cost but ensures that the client's server is safely retrieved and shipped to their desired location by our trained professionals.
8.3 Scheduled Maintenance Pickup: Alternatively, clients may opt to coordinate the pickup of their server during one of our planned maintenance visits to the datacenter. This option allows clients to avoid the remote hands service fee, as it aligns with our existing maintenance schedule. However, clients should be aware that the timing of this option may not always align perfectly with their needs, as it depends on our maintenance calendar.
8.4 Client-Organized Pickup: If clients prefer to handle the shipping process themselves, they must provide packaging materials and arrange for a courier service to pick up their server. We can provide clients with the necessary information to prepare the server for pickup from the location we designate, still there will be remote hands fees for packing the server.
8.5 Client Responsibilities:
8.5.1 Communication and Coordination: Clients are responsible for communicating their equipment pickup requirements and coordinating with us to ensure a smooth and timely process. Failure to communicate or comply with our procedures may result in delays or additional charges.
8.5.2 Compliance with Policies: Clients are expected to comply with all policies outlined in this section regarding equipment pickup and colocation services. Non-compliance may result in the suspension or termination of services.
By continuing the registration process, you confirm that you have read the General Terms and Conditions and you consent to the General Terms and Conditions in which the Provider offers the Services ordered.
